Presentation Summary:

Dr. Olsen will present a conceptual framework for decisional and executive capacity as well as the components of capacity assessment which may serve as the basis for understanding both how and when capacity issues become relevant in estate planning matters for civil attorneys and other estate planning professionals.  She will also propose strategies for those professionals to employ that may help them to determine when clients retain sufficient capacity to proceed with estate planning or enter into contracts and when a formal capacity assessment should be sought from a medical provider.  Lastly, she will provide information that informs assessment for undue influence in this context.

Understand when capacity issues should be considered in estate planning or contractual matters with older adult clients

Describe the components of a capacity assessment

Appreciate when issues of undue influence may be relevant in estate planning or contractual matters

About Our Speaker:

Bonnie Olsen, Ph.D. is a clinical geropsychologist, working in academic medicine for over 25 years. She provides cognitive assessment and psychotherapy in a geriatric primary care setting. As the Vice Chair for Research in the Department of Family Medicine at the Keck School of Medicine at USC, Dr. Olsen is the Principal Investigator on several federally and foundation funded grants focusing on elder abuse identification, prevention, and response in medical settings, facilitating guardianship reform in the court, and interprofessional geriatric clinical education. She has conducted numerous assessments for capacity and lectures on this topic nationally. She has remained dedicated to community service to improve the quality of life for older adults throughout her career.
