Presentation Summary:

Presenters Bette Epstein and Richard Collier have decades of experience both litigating and mediating inheritance disputes.  This program will address issues that arise for trust and estate counsel from the time the proposed client walks in the door through the administration of the estate.  Their discussion will include recognizing and managing conflicts of interest, fiduciary duties vs. attorneys duties, importance of asking the right questions, record maintenance, going to/keeping out of probate court.

Learning Objectives:

Importance of identifying and serving the client.

Importance of being mindful of fiduciary duties.

Importance of keeping records of things done and things not done.


About Our Speakers:

Bette Epstein, Esq. has been mediating trust and estate disputes since 2000. Following a remarkable career first as a licensed Psychotherapist and then as a trust and estate litigator for over 30 years, she turned her focus to alternative dispute resolution and has been helping parties settle their disputes ever since. She is now available as a full-time mediator and discovery referee with ADR Services, Inc. Ms. Epstein is highly regarded as one of the Bay Area’s leading probate specialists. She spent the last 28 years of her litigation career handling trust and estate disputes, contested conservatorships, elder abuse claims, and serving as an expert witness in conservatorship, trust & estate litigation proceedings. As a neutral, she brings her unique emotional intelligence, sharp legal intellect, and psychotherapy background to highly emotional probate disputes, and is able to manage and successfully resolve even the most challenging and complex issues.

 

Richard Collier, Esq has been in practice for more than 40 years as a trial lawyer and over 25 years as a mediator and arbitrator where he is now available through ADR Services, Inc. Since first training as a mediator in 1993, he has mediated or arbitrated to completion over 400 disputes across a wide range of civil law, ranging in complexity from smaller value disputes to large, multi-million-dollar settlements. Mr. Collier prides himself upon thorough preparation – of the participants as well as of himself. He has proven to be particularly effective in disputes encumbered by high emotions. His respect for the emotional dynamics between the parties, as well as his thorough understanding of the facts and law, allow him to build credibility with the parties and their counsel while crafting settlement scenarios to ensure resolution.
