Estate Planning and Administration for Blended Families

Presentation Summary:

This program will address the unique planning considerations for blended families. For the purposes of this discussion, a blended family is defined as one in which at least one spouse has children from a previous relationship. We will explore key steps that should be taken to ensure the client’s wishes are carried out effectively, while minimizing the potential for future conflicts.


We will begin by discussing the importance of property agreements to clearly define the characterization of property as separate or community property. This is essential to prevent the automatic application of default characterization rules that often lead to outcomes inconsistent with the client’s intentions.


Next, we will review various strategies for the disposition of assets upon the death of the first spouse. These include options such as Survivor’s Trusts, QTIP Trusts, Bypass Trusts, and portability of the estate tax exemption. We will also cover the critical considerations surrounding beneficiary designations for retirement accounts and life insurance policies.


The program will then focus on the administration of trusts and retirement accounts during the surviving spouse’s lifetime, as well as the distribution of assets upon their death. Finally, we will examine opportunities for gift and estate tax planning within the context of blended families, particularly for high net worth clients seeking to minimize their estate tax liability.

Understanding the need for pre and post marital agreements to accomplish estate planning goals.

Understanding Trust disposition options at the death of the first spouse- Bypass Trust, QTIP Trust, Survivor’s Trust, Disclaimer Trust and portability of the estate tax exemption.

Understanding retirement account beneficiary designation options and associated inherited IRA rules.
